Open Letter
To RA President Serj Sargsyan,
RA Prime Minister Tigran Sargsyan,
Human Rights’ Defender Armen Harutyunyan
Honorable State Officials,
May 12 of this year will be the second year since my son Levon Gulyan has been
deprived of his life in the yard of RA police station as a result of illegal,
biased and criminal activities of several policemen.
These long and agonizing months of suspense have not brought any results for our
family. No progress has been recorded in the criminal case even after two
instances of the court reversed the decision to terminate the proceedings,
affirmed that pre-trial proceedings of the case hadn’t been carried out in a
comprehensive, full, and objective manner, as well as no adequate assessment
regarding the actions of the police had been made, as a result those guilty for
Levon’s death were not found and punished.
Public trial showed that there is sufficient evidence (testimony of witnesses,
expert assessments, documents, etc) to prove that Levon Gulyan’s death was
caused by the police who have deprived him from liberty illegally, tortured him
and took other illegal actions. So it’s beyond any doubt that the thing that
happened on May 12, 2007 in the administrative building of RA police was not an
accident.
The fact of crime is obvious, people who have committed the crime are known, but
it is already two years that the crime is considered “undisclosed”.
Nevertheless, special investigatory body and officials from prosecutor’s office
don’t show willingness to put any efforts to enforce court decisions and meet
their direct responsibilities. Since seven months of resuming the investigation
of the case, the proceedings are carried out without defendants; this shows the
desire of the legal bodies to terminate the criminal case again.
Even the information provided by different international organizations that
non-efficient and non-sufficient means were used to investigate the case does
not keep the ones responsible for these proceedings from taking actions that
damage international reputation of the Republic of Armenia.
Such operations of special investigatory bodies and prosecutor’s office just
eliminate any traces of hope to reveal the truth and find the justice in the RA
legal system that existed after the above mentioned decisions of the courts.
Levon Gulyan’s family hopes that within the scope of your competence arrangement
of necessary actions will be made that can have a positive impact on this
process. So this letter is the last attempt to draw your attention to the crime
committed two years ago, to the impermissible situation created by inaction of
the legal bodies, and to ask for the protection of the rights violated in
inter-state agencies.
