Expulsion process with a barbarian ending

The attorneys working with "Milano" case organized a press conference, during which once more addressing the process of expulsion of the owner from the area informed that they were going to file a claim with the European Court of Human Rights.

"I am sure we will get a decision from the European Court according to which RA state budget will be responsible for the economic interests of a person", says attorney Hayk Alumyan, "European Court makes decisions against many countries. But there are very different cases. European Court will be shoked with this case when they will see that there is a country in the world where such kind of things occur". 

The area of "Milano" shop at the address of 4 Abovyan was taken from the owner Hovhannes Ghukasyan with the reason "for public and state needs". According to Hayk Alumyan all of the process was carried out by grave legislative violations. "Nobody has concluded a contract with these people, money has not been given, but they have been expelled. I don't know what interests were risen in this case so that such a barbarian attitude was expressed and the law was disrespected", questions the attorney.

According to him the Judicial Act Enforcement Service turned the expulsion process into a barbarian act. There are also records.

"The thing that has happened during the expulsion process cannot be described. If these people had not introduced themselves as employees of JAES nobody could guess that. It seemed that a gang of robbers were attacking", says attorney Hayk Alumyan.

The property of the owner of "Milano" was assessed only 207 mln drams, calculating 1sqm for 5 thousand dollars. Whereas according to the attorney twice of this amount had to be awarded.

"I don't know who, and what interests pursues in this LTD so that the courts give as a present to that company 70% of the property of "Milano" shop".

According to the court decision compensation should be awarded only for the first floor of the shop, whereas there is also a second floor, which was legally bought by Ghukasyan from the state.

"Only a person with great imagination can take two floors for one floor", said the attorney.

A contract has not been concluded with the owner of "Milano" up to now, and the money has not been compensated yet.

"Without any contract enforcement proceedings were terminated, which is considered a violation. The main purpose of JAES is to expel Ghukasyan with his family from that place", says Alumyan.
