The appeals were rejected on Gevorg Kotsinyan’s case

On March 29 the RA
Court of Appeal (chief judge Sergey Chichoyan) rejected all the appeals on case
of Gevorg Kotsinyan who died of being battered by his four co-servicemen. The
court upheld the decision made by the Court of General Jurisdiction of Syunik
marz by which junior sergeant Margar Davtyan was sentenced to 11 years and 6
months imprisonment, soldiers Taron Suvaryan and Vahe Aghajanyan for 11 years
imprisonment and senior lieutenant Arman Rafayelyan for 3 years imprisonment.
Amnesty was applied to A. Rafayelyan and he was released from punishment.

To remind, the
representatives of the victim’s successor, advocates Edmon Marukyan and Karen
Tumanyan demanded with an appeal to acknowledge the fact of violation of Gevorg
Kotsinyan’s right to life.

“We find that the
government is also responsible for murder because a person who was under the
control of state body was deprived of life. We also claim the compensation for
moral damages (5 million AMD) and with that demand we’ll reach the European
Court for Human Rights as the domestic legislation determines no compensation
for moral damage” said Karen Tumanyan to

To remind, according to
forensic examination the cause of 19-year-old Gevorg Kotsinyan’s death killed
in NK Army of Defense Arayi Ler military unit on February 6, 2011, was the reflex cardiac arrest. The investigation found
out that Kotsinyan had been battered by his four co-servicemen who were under
the influence of alcohol.
