The appeals on Kotsinyan’s case were pronounced

On
March 15 the appeals were pronounced in the RA Criminal Court of Appeal (chief
judge Sergey Chichoyan) on case of serviceman Gevorg Kotsinyan who died of
being battered by four co-servicemen.
The
victim legal representatives advocate Edmon Marukyan and advocate Karen
Tumanyan demand that the court recognize the fact of violation Gevorg Kotsinyan’s
right to life.
“We
find that the government is also responsible for the murder because a person
who is under the supervision of state body was deprived of life. We also demand
a compensation for moral damages (AMD 5 million) and with that demand we’ll
reach European Court of Human rights (ECHR) as the interstate legislation
doesn’t determine a compensation for moral damages” said Karen Tumanyan to www.hra.am.
The
advocates of defendants Margar Davtyan and Taron Suvaryan also appealed
demanding to reverse the verdict made on November 14, 2011 by the RA Court of General
jurisdiction of Syunik marz and set a fair punishment.
The
next court session is on March 29 at 1:00 pm.
To
remind, the reason of 19-year-old Gevorg Kotsinyan’s
death who was murdered on February 6, 2011 in Nagorno Karabakh Army of Defense
Arayi Ler military unit, is the reflex cardiac arrest according to the results
of forensic expertise. The investigation found out that Kotsinyan was battered
by four co-servicemen who were under the influence of alcohol.
Junior
sergeant Margar Davtyan was sentenced to 11 years 6 months imprisonment to, the
soldiers Taron Suvaryan and Vahe Aghajanyan to 11 years, and senior lieutenant
Armen Rafayelyanto3 years. An amnesty was applied against Armen Rafayelyan
and he was exempted from punishment.
