Complaint on violation of Gevorg Kotsinyan’s right to life will be sent to European Court of Human Rights

On 17 May, 2012 the Court of
Cassation of the Republic of Armenia decided that the complaints brought by the
sides of the case of military servant Gevorg Kotsinyan’s death be returned to
the applicants.

Let us remind that on 29 March, 2012
the Court of Appeals on Criminal Cases refused the complaints of
defendants Margar Davtyan and Taron Souvaryan and of the victim’s legal
successors.


Karen Toumanyan, legal successor of the victim, is preparing to submit a
complaint to the European Court of Human Rights with demand to register the
fact of violation of Gevorg Kotsinyan’s right to life.

“We believe that the state is
responsible for the murder, because the victim lost his life while being under
supervision of a state body. We also restate the demand of moral compensation
(5 million Drams) and with this demand we will reach to the European Court of
Human Rights, because the state legislation does not define the compensation
for moral damage,” Karen Toumanyan told

Let us remind that on 6
February, 2011 Gevorg Kotsinyan, 19 year-old, was killed near Mt Ara, in a
military unit of the Republic of Nagorno Karabakh defense army. The forensic
expertise concluded that the death was caused by cardiac arrest. The investigation revealed that Kotsinyan was beaten by
hisfour army mates, who were in a state of alcoholic intoxication.
